Home I want to purchase has a shop that was built over onto neighbors property?

I am being told since the seller has made us aware of the problem it is legal for them to sell here in CA. Which I found out was true. So now I want to use that shop, my options are what? Ask the neighbor to sell me 11 foot strip of land? Because in Ca you have to build things 5 feet from property line. Ask seller to lower price as I have to demolish building since I don’t want to spend money on 11 more feet(plus not feasible way parking is for next lot)..I had thought to remodel shop down but it’s only like 24 by 50 so that’s cutting off quite a chunk. Anybody have any ideas?

No offense, but the ideas you receive here will be just worth you paid for them. Seek competent legal counsel so you’ll feel more confident that the information is accurate and legal.

You can most likely proceed with the purchase just as if it were a normal building. It is apparent that all parties have known about this for a while, so I’m guessing the Title Insurance Company would insure or bond over this encroachment and allow it. I’d suggest having your attorney check with his or your title company that you would use for closing and see how they are perceiving this issue and if it has been insured over in the past. If so odds are you can use it just as it is. Good luck!
